Court ruling regarding Temporary Protected Status
On Feb. 10, a federal appeals court decided to revisit a case that could decide the fate of immigrants currently living and working in the U.S. legally under Temporary Protected Status. In the latest ruling in a long-running legal battle, the 9th Circuit Court of Appeals voided a 2020 court ruling that had allowed the Trump administration to terminate TPS for immigrants from El Salvador, Haiti, Honduras, Nepal, Nicaragua and Sudan. The appeals court now will hear the case on “en banc”—with all judges of the court hearing the case—rather than by a three-judge panel as had been done previously. This is a significant victory for individuals with TPS and could affect ongoing negotiations with the Biden administration regarding future TPS renewals. TPS provides immigrants admitted to the U.S. on humanitarian grounds with temporary work authorization that can be extended depending on conditions in the individual’s home country.

IRS guidance launches incentive programs for energy projects
On Feb. 13, the IRS issued two new notices relating to energy tax incentive programs—the Qualifying Advanced Energy Project Credit and the Low-Income Communities Bonus Credit Program, enacted as part of the Inflation Reduction Act.
Notice 2023-17 provides initial program guidance for potential applicants for allocations of calendar year 2023 capacity limitation and the general eligibility requirements; a description of the four statutory facility categories for which an eligible facility may request an allocation; amounts of capacity limitation reserved for each facility category; a general description of the program design and goals; the application review process; and the proposed timeline for opening two 60-day application periods in 2023 based on project categories.
Notice 2023-18 establishes the section 48C(e) program to allocate $10 billion of section 48C credits ($4 billion of which may only be allocated to projects located in certain energy communities’ census tracts) and provides initial program guidance. This notice also provides the general rules for determining the section 48C credit; definitions of qualifying advanced energy projects; and the procedures for allocating the credits.
