Border security negotiations continue in Congress

Negotiations continue among key senators to craft a bipartisan deal to strengthen border security as part of a broader bill to provide funding for Israel, Taiwan and Ukraine. The discussions are focused primarily on the scope of eligibility under asylum laws, humanitarian parole programs and the possibility of expedited work permits for certain migrants, with the goal of reducing record levels of migration at the U.S. southern border. Some reports indicate progress is being made while others indicate there are still many details to be worked out. Also, if a deal passes the Senate, House Republicans have indicated they will not accept any border security deal that does not include the Secure the Border Act (H.R. 2), legislation passed in the House in 2023 on a straight party-line vote. H.R. 2 is a nonstarter in the Senate. To further complicate matters, on Jan. 24, Senate Republican Leader Mitch McConnell (R-Ky.) said the time for a border security and immigration deal may have passed as former President Trump, fresh off primary wins in Iowa and New Hampshire, has made it clear he does not favor Republicans cutting a deal with President Biden because it would take a key campaign issue off the table in the general election.

Tax Relief for American Families and Workers Act passes committee

On Jan. 19, the House Ways and Means Committee passed the bipartisan Tax Relief for American Families and Workers Act, legislation led by Chairman Jason Smith (R-Mo.) and Senate Finance Chairman Ron Wyden (D-Ore.). This bill restores various expired business provisions and provides an enhanced Child Tax Credit, among other items, and could receive a vote next week on the House floor.

This legislation will:

  1. Expand/restore research and development expensing, interest deductibility and 100% bonus depreciation for qualified property
  2. Provide an enhanced Child Tax Credit that provides inflation relief and eliminates the penalty for larger families
  3. Include permanent small-business expensing
  4. End the Employee Retention Tax Credit program early to pay for the previously listed provisions

Under current law, taxpayers can claim a COVID-related Employee Retention Tax Credit until April 15, 2025. This section bars additional claims after Jan. 31, 2024.

NRCA supports this legislation and encourages swift passage by the full House.
