Occupational Safety and Health Administration inspectors have cited Miller Building Systems LLC, Arcola, Ill., for again exposing employees to falls from elevation as the company performed residential framing work in January, March and May, according to OSHA. The company is not an NRCA member.
OSHA inspectors observed employees of Elmer Miller, operating as Miller Building Systems, standing, climbing and walking on trusses and top plates on residential homes—sometimes at heights greater than 18 feet above ground level—without adequate fall protection. OSHA alleges when workers used fall protection, they were not directed to properly tie it off or secure body harnesses.
The agency observed the violations Jan. 11, Jan. 26, March 13 and May 2 at residential job sites in Mahomet, Ill., and Savoy, Ill.
OSHA cited Miller with four willful violations for intentionally failing to use adequate fall protection and assessed $354,912 in proposed penalties.
Since 2019, OSHA has cited Miller Building Systems 17 times—including seven times in 2023—for fall-related violations. The employer contested the 2023 citations and awaits a hearing before an administrative law judge with the Occupational Safety and Health Review Commission to challenge the violations.
